Gut-Scrapers – CD and Vinyl Sales

ARTICLE 1 – PURPOSE
These Terms and Conditions govern the contractual relationship between Fred Fages, sole proprietor, and any customer wishing to make a purchase via the gutscrapers.com website.

ARTICLE 2 – PRODUCTS AND SERVICES
The seller offers the following products for sale:
- Audio CDs
- 33 rpm Vinyl records
The essential characteristics of the products are presented on each product page. Photographs are as accurate as possible but are not binding on the seller.
ARTICLE 3 – PRICES
Prices are indicated in euros including all taxes. VAT is not applicable in accordance with article 293 B of the French General Tax Code.
The displayed prices include only the product price. Shipping costs are displayed separately before order validation.
The seller reserves the right to modify prices at any time. Products will be invoiced at the price in effect at the time of order validation.
ARTICLE 4 – ORDERING
Any order constitutes acceptance of these Terms and Conditions. The customer acknowledges having received, prior to placing the order, in a readable and understandable manner, these Terms and Conditions.
The ordering process includes the following steps:
- Product selection and addition to cart
- Cart validation
- Entering delivery details
- Choosing delivery method
- Terms and Conditions validation
- Secure online payment (Stripe)
- Order confirmation by email
ARTICLE 5 – PAYMENT
Payment is made online by credit card via the secure Stripe platform.
Payment data is encrypted and never transmitted in clear text over the network. The seller does not store any banking data.
Accepted cards are: Visa, Mastercard, American Express, Apple Pay, Google Pay.
The order will only be validated after payment confirmation by Stripe.
ARTICLE 6 – DELIVERY
Delivery area: Metropolitan France, European Union, Worldwide
Shipping costs:
Metropolitan France:
- CD: €3.50
- Vinyl: €6.50
European Union:
- CD: €8.00
- Vinyl: €15.00
Rest of the world:
- CD: €12.00
- Vinyl: €22.00
Delivery times:
- France: 2 to 5 business days
- European Union: 5 to 10 business days
- Rest of the world: 10 to 20 business days
Delivery times are provided as an indication. The seller cannot be held responsible for delays caused by the carrier.
Products are shipped to the delivery address indicated during the order. It is the customer’s responsibility to verify the accuracy of this address.
In case of damaged or undelivered packages, the customer must contact the seller as soon as possible at guts.management@gmail.com.
ARTICLE 7 – RIGHT OF WITHDRAWAL
In accordance with article L221-18 of the French Consumer Code, the customer has a period of 14 days from receipt of the product to exercise their right of withdrawal without having to justify reasons or pay penalties.
Important exception:
In accordance with article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for audio or video recordings and computer software when they have been unsealed by the consumer after delivery.
Consequently, any CD or vinyl whose cellophane packaging has been opened cannot be returned.
To exercise the right of withdrawal, the customer must notify their decision by email to guts.management@gmail.com.
The product must be returned in its original condition (sealed packaging intact) and complete (accessories, manual…) within 14 days following communication of the withdrawal decision.
Return costs are the customer’s responsibility.
In case of withdrawal, the seller undertakes to refund the customer within 14 days from receipt of the returned product. The refund will be made using the same payment method as used for the order.
ARTICLE 8 – WARRANTIES
All products benefit from the legal warranty of conformity (articles L217-4 and following of the French Consumer Code) and the warranty against hidden defects (articles 1641 and following of the French Civil Code).
In case of lack of conformity, the customer may request:
- Product repair or replacement
- Failing that, price reduction or contract termination
The customer must report any apparent defect within 7 days following receipt.
ARTICLE 9 – PERSONAL DATA
In accordance with the General Data Protection Regulation (GDPR), the customer has the right to access, rectify and delete their personal data.
Collected data is used solely for order processing and is never transmitted to third parties.

ARTICLE 10 – INTELLECTUAL PROPERTY
All elements of the gutscrapers.com website (texts, images, logos, music) are protected by copyright and intellectual property rights.
Any reproduction, representation, modification, publication or adaptation is prohibited without prior written authorization.
ARTICLE 11 – LIABILITY
The seller cannot be held responsible for:
- Service delays or interruptions beyond their control
- Temporary inability to access the site
- Damage resulting from improper use of products
